Whisker Terms of Use

1. Agreement

By downloading, installing, accessing, or using Whisker, you agree to these Terms, the Whisker EULA, and any applicable purchase terms. If you do not agree, do not use the product.

2. The product

Whisker is a Windows application that provides live transcription and translation features for professional interpreting workflows. Features may include local processing, optional Cloud-provider integrations, model management, diagnostics, updates, and commercial authorization.

3. License and entitlement

Your right to use an official Whisker binary is governed by the EULA and the purchase or trial terms associated with the product. The current offer is a USD 79 perpetual Regular license, a USD 59 Founders Edition for the first 50 licenses, a seven-day trial, and one active Windows PC per paid entitlement.

The source code and official binaries are not transferred to you. Whisker-original source is proprietary. Third-party components remain subject to their own licenses and notices.

4. Acceptable use

You must use Whisker lawfully and must not:

• Circumvent activation, authorization, device, update, or integrity controls.
• Share or misuse license keys, device tokens, or provider credentials.
• Redistribute or resell official Whisker binaries except as expressly authorized.
• Use the product to infringe another person's rights or violate a provider's terms.
• Use generated transcription or translation as a substitute for professional judgment in a high-consequence decision.

5. Cloud providers

Cloud features are optional. If you enable one, you authorize the selected provider to process the audio and related data required for that session under the provider's terms. You are responsible for your provider account, API credentials, usage charges, permissions, and compliance with the provider's acceptable-use rules.

6. User content

You retain your rights in content you process through Whisker. You are responsible for having the permissions required to capture, transcribe, translate, edit, or transmit that content. Do not process content in a way that violates confidentiality, privacy, copyright, professional, or contractual obligations.

7. Payments and refunds

Prices, taxes, payment methods, refund handling, and payment-provider terms are shown in the applicable purchase flow. Creem acts as the Merchant of Record for purchases made through its checkout and handles transaction processing, invoicing, applicable indirect taxes, and transaction-related refund or chargeback processing under its applicable terms.

8. Updates and availability

Whisker may provide application updates, model updates, security fixes, or provider integration changes. Third-party providers may change availability, pricing, capabilities, limits, or terms independently.

9. Intellectual property

Whisker, Whisker-original software, documentation, artwork, product design, name, logos, and related branding belong to the publisher or their respective owners. Third-party software, models, runtimes, and assets are governed by their own licenses.

10. Disclaimer

WHISKER IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. TRANSCRIPTION AND TRANSLATION MAY BE INACCURATE, INCOMPLETE, DELAYED, OR UNSUITABLE FOR A PARTICULAR PURPOSE. YOU REMAIN RESPONSIBLE FOR REVIEWING OUTPUT AND MAKING PROFESSIONAL DECISIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PUBLISHER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO WHISKER, A PROVIDER, OR THESE TERMS.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

12. Suspension and termination

The publisher may suspend or terminate access where necessary to address material breach, fraud, abuse, security risk, or a legal requirement. The EULA and applicable purchase terms govern the effect on an already-issued product entitlement.

13. Changes

The publisher may update these Terms for future versions or services. The effective date identifies the version in force. Changes do not retroactively remove rights already granted except as required by law or expressly agreed.

14. Contact and governing law

Before public release, publish the publisher's full legal identity, address, support contact, governing law, venue, and any mandatory consumer disclosures in this section and in the purchase flow.
